Point of Sale Constitution
Article 1 (Purpose)
1. These Terms and Conditions stipulate the terms and conditions under which SENSE OF HUMOUR(hereinafter referred to as "the Company") provides a point service(hereinafter referred to as the "Service") to members who have registered as members(hereinafter referred to as "Member") in accordance with the Point System Agreement(hereinafter referred to as the "Constitution")
2. Any matters related to the service that are not stipulated in the Terms and Conditions shall be governed by the Constitution of SENSE OF HUMOUR.
Article 2 (Granting of Points)
1. The Company grants "points"(hereinafter referred to as the "point") to members when they purchase goods or use services at SENSE OF HUMOUR(hereinafter referred to as the "Shop"), Inc. in a manner designated by the Company, or when the Company deems it appropriate to do so.
2. The services and transactions for which points are awarded(hereinafter referred to as the "Covered Transactions"), the rate at which points are awarded, and other conditions under which points are awarded are determined by the Company and announced to members on the relevant page of the designated website.
3. Points will be awarded 14 days after the completion of the shipment of goods after the qualifying transaction is made. If the Company confirms that the transaction has been cancelled or returned, no points will be awarded for the transaction. If the price of the transaction has been changed, points will be awarded based on the changed purchase price.
4. The final decision as to whether or not to award points for a particular transaction, the number of points to be awarded, and other matters related to the awarding of points shall be made by the Company.
*Points will not be awarded for products other than SENSE OF HUMOUR products(La Bouche Rouge products, etc.)
*Points can be used.
Article 3 (Management of Points)
1. The Company shall notify members of the number of points they have earned, the number of points they have used, and the balance of their point total in a manner prescribed by the Company.
2. If a member has any doubts about the number of points in the preceding paragraph, the member should immediately contact the Company and explain the details.
3. The final decision regarding the number of points in Paragraph 1 shall be made by the Company.
Article 4 (Prohibition of Combining Points and Multiple Registrations)
1. Members may not transfer or pledge their points to other members, share points among members, or combine points.
2. If a member has multiple membership registrations, the member may not combine the points held by each membership.
Article 5 (Cancellation and Extinction of Points)
1. If, after points have been granted, the Company deems it appropriate to cancel the points granted due to a return, cancellation, or other reason, the Company may cancel the points granted for the relevant transaction.
2. The Company may cancel all or part of the points held by a member without prior notice to the member if the Company deems that the member has committed any of the following
(1) In the event of illegal or fraudulent activities
(2) If there is a violation of the Terms of Use, the Membership Rules, or any other rules or regulations set forth by the Company
(3) If the Company otherwise deems it appropriate to cancel the points granted to a member.
3. Points will automatically expire after the validity period (one year from the date of grant) specified by the Company.
4. The Company will not provide any compensation for cancelled or lapsed points and will not be liable for any loss or damage.
Article 6 (Use of Points for Settlement)
1. Members may use their points to pay all or part of the settlement price (including product price, shipping and handling charges, or consumption tax)at the Shop in a manner and at a conversion rate determined by the Company.
2. The Company may limit the services, products, etc. that are eligible for point use under Paragraph 1, or may impose conditions on the use of points.
3. If a member cancels a transaction under Paragraph 1, the points used for the transaction will be returned to the member in principle, and no cash refund will be made.
4. If a member uses points to pay the full settlement amount and the settlement amount is subsequently reduced for some reason, the points or cash will be refunded in accordance with the preceding paragraph. If a member uses points to pay for a portion of the settlement amount and the settlement amount is subsequently reduced for some reason, the member will first receive a refund by another payment method, and if there is still a shortfall in the amount that needs to be returned, points or cash will be returned in accordance with the preceding paragraph for the amount of the shortfall.
5. If the settlement amount is increased for some reason after the member has used points to pay the settlement amount, the member shall pay the increased amount by another payment method. However, if a member has used points to pay the full amount of the settlement amount and has chosen to use all points held by the member for payment, the points held by the member shall be given priority for payment of the increased amount, and if the remaining amount of points is insufficient to pay the increased amount, the member shall pay the insufficient amount by another payment method.
6. If a member uses all of his/her points to pay for a transaction, and if new points are granted or returned to the member within a certain period of time determined by the company after the transaction, the points granted or returned will automatically be applied to the payment for the transaction. The points granted or returned shall be automatically applied to the payment of the settlement price of the transaction.
Article 7 (Accidents, etc.)
In the event of delay, loss, theft, damage, destruction, or any other accident during or after delivery of goods or services for which payment is made under Article 6, the Company shall not be liable for any loss or damage, and points may not be refunded, unless such accident is the responsibility of the Company.
Article 8 (Cancellation of Points after Use of Points)
If points are cancelled in accordance with Article 5.1 or 5.2 after a member has used points for payment in accordance with Article 6, the transaction subject to such payment (hereinafter "Point Use Transaction") may be cancelled or put on hold. If a point transaction has already been executed or is about to be executed, the member shall immediately pay the Company in cash or by a payment method designated by the Company any amount that is insufficient due to point cancellation.
Article 9 (No Redemption)
Members may not exchange points for cash under any circumstances.
Condition 10 (Use by third parties)
1. Points may only be used by the member himself/herself, and may not be used by any third party other than the member in question.
2. The Company considers the use of points by a specific membership number to be the use of the person who has that membership number. Even if the use of points by a third party is unauthorized, the Company will not refund the points used and will not be liable for any damages incurred by the member.
Article 11 (Loss and Suspension of Membership)
If a member loses his/her membership status, he/she shall lose all rights related to the use of the service, including the right to redeem points and rewards, and shall not acquire any claims against the Company as a result of the loss of membership status.
Article 12 (Disclaimer)
Although the Company will do its best to operate the Service based on the technical standards of the time, the Company does not guarantee that failures will not occur. The Company shall not be held liable for system interruptions, delays, discontinuation, or loss of data due to communication line or computer failures, problems related to point usage, damages caused by unauthorized access to data, or any other damages incurred by members in connection with the Service.
Article 13 (Changes to the Service)
1. The Company may, without prior notice to members, change the Terms of Service, the contents of the Service, or the terms and conditions of the Service (including, but not limited to, discontinuation of points, suspension of points, change of eligible sites or transactions, or change of the point award rate or utilization rate), and may terminate or suspend the Service. The Service may be terminated or suspended at any time. Members shall agree to this in advance.
2. The Company shall not be liable for any disadvantages or damages incurred by members as a result of the changes described in the preceding paragraph.
